Terms of Service

1. Agreement and business identity

These Terms govern purchases from and use of Autumn Flow’s website, online courses, and related services. Autumn Flow is operated by Michele McCoy, an Arkansas sole proprietor.

By purchasing a course, creating an account, or using the course platform, you agree to these Terms and the Privacy Policy.

2. Course purchases, hosted access, and downloads

Courses are sold as one-time purchases unless the checkout page clearly states otherwise. A purchase gives you a personal, limited, non-transferable right to access and use the purchased course. It does not transfer ownership of the course or its materials.

Your purchase includes access to the course through Autumn Flow’s course platform. You may stream the lessons and use the course features available through your account.

Course videos and other materials marked as downloadable may be saved for your personal, noncommercial use. You may keep those personal copies and revisit them at any time. Downloading and maintaining backup copies is your responsibility. Downloads may not be shared, transferred, redistributed, resold, posted online, or used commercially.

3. 7-day course refund policy

You may request a full refund within seven calendar days after purchase by emailing michele@autumnflow.com. Approved refunds are returned to the original payment method, subject to payment-processor timing. After a refund, your hosted course access ends and you must delete any course videos or other course files you downloaded.

Autumn Flow does not offer routine partial refunds. Requests received after the seven-day period are generally not eligible, except for duplicate charges, a material access or technical problem that Autumn Flow cannot reasonably resolve, or where a refund is required by applicable law.

Payment-processing fees may not be returned to Autumn Flow, but that will not reduce the amount of an approved full refund to you. Your bank or payment provider may require additional time to post the refund. Autumn Flow may deny refund requests involving repeated purchases and refunds, fraudulent activity, or other apparent abuse of this policy, except where a refund is required by applicable law.

4. Eligibility, accounts, and acceptable use

You must be at least sixteen years old to create an Autumn Flow account or use the course platform. If you are sixteen or seventeen, you may use Autumn Flow only with the permission and involvement of a parent or legal guardian, and a parent or legal guardian must make or authorize the purchase. No person under sixteen may create an account, access, or use the course platform.

You must provide accurate account information, keep your login credentials secure, and promptly report suspected unauthorized access. Course access is personal to the enrolled user and may not be shared or transferred. A parent’s or legal guardian’s permission, involvement, or purchase authorization does not permit the enrolled user’s login credentials to be shared.

Except for personal downloads expressly permitted under Section 2, you may not copy, record, reproduce, publicly distribute, resell, or commercially use course materials without written permission. You may not share login credentials, bypass access controls, scrape the site, interfere with the service, or use it unlawfully.

Autumn Flow may suspend or terminate access for a material violation of these Terms, fraud, abusive chargebacks, a security threat, or unlawful conduct. When reasonably practical, Autumn Flow will provide notice and an opportunity to correct a non-urgent violation. Termination for a violation does not create a right to a refund except where required by law.

5. Intellectual property

Course videos, text, downloads, photographs, graphics, branding, and other materials made available through Autumn Flow are owned by Michele McCoy, Autumn Flow, or the applicable instructor or rights holder and are protected by intellectual-property laws.

A course purchase gives you only the personal access, use, and download rights described in these Terms. Except for personal downloads expressly permitted under Section 2, it does not grant permission to copy, record, reproduce, distribute, publicly display, resell, modify, or commercially use the materials, names, likenesses, trademarks, or branding without written permission from the applicable rights holder.

All rights not expressly granted are reserved.

6. Physical activity and educational disclaimer

Hoop dance is a physical activity and involves inherent risks, including falls, strains, collisions, and other injuries. You are responsible for choosing a safe practice area, using appropriate equipment, working within your abilities, and stopping if you experience pain, dizziness, or other concerning symptoms.

By participating, you knowingly accept the ordinary risks inherent in this activity to the extent permitted by law.

Course content is provided for general educational purposes. It is not medical advice and does not guarantee any particular result. Consult an appropriate healthcare professional before participating if you have an injury, pregnancy, medical condition, or other concern that could affect your ability to participate safely.

7. Third-party services and links

Autumn Flow relies on third-party providers for course hosting, payment processing, email delivery, and other business operations. Your use of those services may also be subject to their terms and privacy practices.

Autumn Flow is not responsible for interruptions, outages, or actions by third-party providers that are outside its reasonable control. If such an issue affects course access, Autumn Flow will take reasonable steps to restore access or provide another practical solution when possible.

Courses may also contain links to websites or resources operated by others. Autumn Flow does not control or guarantee the continued availability, accuracy, security, or content of those third-party resources.

8. Changes to courses and these Terms

Autumn Flow may update course content, features, the website, or these Terms from time to time.

If these Terms change materially, Autumn Flow will post the revised version with a new effective date and provide additional notice when required by law or reasonably appropriate. Changes will apply prospectively unless applicable law permits otherwise.

Course purchases follow the hosted-access and download terms in Section 2.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, Autumn Flow’s website and courses are provided on an “as available” basis. Autumn Flow does not guarantee uninterrupted or error-free access, compatibility with every device, or any particular learning, fitness, business, or personal result.

To the fullest extent permitted by law, Autumn Flow and Michele McCoy will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or courses.

For any claim directly related to a purchased course, Autumn Flow’s total liability will not exceed the amount paid for that course.

These limitations do not apply where liability cannot legally be limited or excluded, including liability resulting from willful misconduct or gross negligence.

10. Governing law and disputes

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.

Before filing a formal claim, you and Autumn Flow agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing a reasonable opportunity to respond.

If the dispute cannot be resolved informally, it must be brought in a state or federal court serving Baxter County, Arkansas, except where applicable consumer law requires otherwise.

These Terms do not include mandatory arbitration or a class-action waiver.
